1. Agreement to These Terms
These Terms of Service (“Terms”) are an agreement between you and Riverstone Investment LLC (“Riverstone,” “we,” or “us”) governing your access to and use of our online portal (the “Portal”).
By checking the acceptance box in the Portal, or by continuing to use the Portal, you agree to these Terms. If you do not agree, your option is to stop using the Portal. Declining does not affect your lease, your tenancy, or any management agreement you have with us — those are separate agreements, and you may always do business with us by phone, email, mail, or in person.
2. Your Account
- You must provide accurate information and keep it current.
- You are responsible for keeping your password confidential and for activity that occurs under your account.
- Notify us promptly if you believe your account has been accessed without your permission.
- Accounts are for the named resident, owner, or authorized representative only. Do not share your login.
3. Electronic Communications and Electronic Signatures
By using the Portal, you consent to receive notices, statements, disclosures, and other communications from us electronically — through the Portal or at the email address on your account — rather than on paper.
System requirements. To receive and retain electronic communications you need: a current version of a major web browser (Chrome, Safari, Firefox, or Edge), an active email account, an internet connection, and the ability to view PDF files and to print or save documents.
Electronic signatures. Where the Portal allows you to sign a document by typing your name and confirming your intent, that action is your legal signature under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. Ch. 96) and the Minnesota Uniform Electronic Transactions Act (Minn. Stat. Ch. 325L). It has the same legal effect as a handwritten signature. We record the date, time, and IP address associated with each signature.
Withdrawing consent and paper copies. You may withdraw your consent to electronic communications at any time, and you may request paper copies of any document, at no charge, by contacting us using the details on our Contact page. Withdrawing consent may limit which Portal features you can use.
4. Payments
- Payments made through the Portal are processed by third-party payment providers under their own terms. We do not store full payment card numbers.
- A payment is not complete until funds settle. A failed, reversed, or returned payment may result in late fees and returned-payment fees as provided in your lease and by Minnesota law.
- Balances shown in the Portal are provided for convenience. If a Portal balance conflicts with your lease or a written statement from us, the lease and written statement control. Please tell us right away if a balance looks wrong.
5. Maintenance Requests
The Portal is the preferred way to submit maintenance requests so they are documented and tracked. Do not use the Portal to report an emergency. For fire, gas odor, flooding, or any threat to life or safety, call 911 first, then contact us by phone.
6. Acceptable Use
You agree not to: use the Portal for any unlawful purpose; attempt to access another user’s account or data; upload malicious code; scrape, copy, or reverse engineer the Portal; or interfere with its operation or security.
7. Privacy and Your Information
We collect and use the information you provide in the Portal to manage your tenancy or ownership relationship — including processing applications, collecting rent, handling maintenance, and meeting legal obligations. We share information with service providers (such as payment processors, screening agencies, and email providers) only as needed to deliver these services, and as required by law.
Tenant screening reports are handled in accordance with the federal Fair Credit Reporting Act. You have the right to know if information in a screening report was used against you, and to dispute inaccurate information with the reporting agency.
8. Availability and Accuracy
The Portal is provided on an “as is” and “as available” basis. We work to keep it accurate and available but cannot guarantee uninterrupted access. Scheduled maintenance, outages, or errors may occur. A Portal outage does not excuse a rent obligation — if you cannot pay through the Portal, contact us to arrange payment.
9. Dispute Resolution
Informal resolution first. If you have a concern about the Portal, please contact us before taking any formal action. We ask that you give us thirty (30) days to work with you toward a resolution, and we commit to responding in good faith. Most issues are resolved at this stage.
If informal resolution does not work. Any dispute arising out of your use of the Portal will be resolved in the state or federal courts located in Minnesota, and Minnesota law governs. Nothing in these Terms waives any right you have under Minn. Stat. Ch. 504B or any other law that cannot be waived by agreement, and nothing here limits your ability to bring a claim in small claims court or to file a complaint with a government agency.
10. Relationship to Your Lease or Management Agreement
These Terms cover the Portal only. Your lease, management agreement, and any addenda govern your tenancy or ownership relationship. If these Terms ever conflict with your lease or management agreement, your lease or management agreement controls.
11. Changes to These Terms
We may update these Terms. When we make a material change, we will post the updated version here, update the version number and effective date, and ask you to review and accept the updated Terms the next time you sign in. Continued use of the Portal after acceptance means you agree to the updated Terms.

13. Electronic Signatures and Electronic Records
This section is our consumer disclosure under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001, the “E-SIGN Act”) and the Minnesota Uniform Electronic Transactions Act (Minn. Stat. ch. 325L). Please read it before signing anything electronically with us.
Your consent
When you check the electronic signature box on an application, lease, or other document, you agree that: (a) you consent to receive records and disclosures from Riverstone Investment LLC electronically rather than on paper; and (b) your typed name, click, or other electronic mark is your legal signature and has the same effect as a handwritten signature on paper.
We are paperless by default
We conduct business electronically. Applications, leases, notices, statements, and decisions are delivered by email or through your portal. In limited situations we will still issue paper — where a law, court order, or government agency requires a physical document, or where you ask us for one.
Your right to paper copies
You may request a paper copy of any record we have provided you electronically, at no charge. Contact us through the Contact page with the document and date. Requesting a paper copy does not by itself withdraw your consent to electronic records.
Withdrawing your consent
You may withdraw your consent to do business electronically at any time, at no cost, by contacting us. Withdrawal takes effect once we have had a reasonable time to process it and applies only going forward — it does not undo the legal validity of anything you already signed electronically. If you withdraw consent during an application, we may not be able to continue processing that application electronically.
Keeping your contact details current
You must give us a working email address and tell us promptly if it changes, through your portal or the Contact page. Notices sent to the address we have on file are considered delivered.
What you need to read and keep these records
To access and retain electronic records you need: a device with a current web browser; an active email account able to receive messages from us; the ability to view PDF files; and either a printer or enough storage to save copies. If our requirements change in a way that creates a material risk you could not access your records, we will notify you and give you the chance to withdraw consent without charge.
Signature must match
The name you type as your electronic signature must match the full legal name you provided on the document. A signature that does not match will be rejected.
Scope
This consent applies to this and future documents between you and Riverstone Investment LLC unless you withdraw it. Nothing here waives any right you have under the E-SIGN Act, Minn. Stat. ch. 325L, or any other law that cannot be waived by agreement.
